AUKU: Disciplinary Actions on Student Speech and Assembly at Public Universities Halted Immediately, Says MoHE

PUTRAJAYA, Aug 28 — All disciplinary proceedings at public universities involving freedom of speech, expression of views, public criticism, and peaceful assembly must be halted with immediate effect, the Higher Education Ministry (MoHE) announced today.

The ministry stated that the directive serves as an immediate step to expand students’ freedom of expression and right to association, following remarks by Prime Minister Datuk Seri Anwar Ibrahim at the Malaysia MADANI Intellectuals Forum Series 13 regarding the repeal of the Universities and University Colleges Act 1971 (AUKU). MoHE is currently reviewing existing legal mechanisms to implement the Prime Minister’s directive immediately, rather than waiting for the complete drafting of a new legal framework.

As part of these interim measures, several provisions under AUKU and existing Student Disciplinary Rules restricting student activities have been identified for exemption. These exemptions encompass the freedom to manage student associations and clubs, organise student-led activities, express views, assemble peacefully, utilise communication platforms, and publish or distribute documents.

“At the same time, such freedoms must go hand in hand with responsibility and respect for the rule of law. Acts involving violence, vandalism, property damage, criminal offences, academic misconduct or breaches of valid disciplinary rules remain subject to the laws and regulations in force,” the ministry said in a statement today.

MoHE added that a similar review will be conducted for institutions not governed by AUKU, specifically the International Islamic University Malaysia (IIUM) and Universiti Teknologi MARA (UiTM), to align their student regulations with the ongoing reform measures. The ministry reiterated its commitment to developing an open, structured, and inclusive higher education governance framework through continuous engagement with all relevant stakeholders.
