High Court Grants PN Leave For Judicial Review But Rejects Immediate Stay On ROS Suspension Order

Perikatan Nasional Johor election defeat

KUALA LUMPUR, Oct 13  – The High Court in Kuala Lumpur on Tuesday, October 13, 2026, dismissed an application by Perikatan Nasional (PN) for an interim stay against a suspension order issued by the Registrar of Societies (ROS) that halts all the political coalition’s activities.

However, High Court Judge Datuk Azizan Md Arshad granted PN leave to proceed with a full judicial review to challenge the legality of the ROS suspension order.

Delivering his decision in chambers, Judge Azizan ruled that the coalition had met the required legal threshold to commence judicial review proceedings, setting October 22, 2026, to hear the inter partes stay application.

The ROS issued its order suspending all PN activities effective September 23, 2026, under Subsection 13(2A) of the Societies Act 1966 following an initial notice served on September 22.

Applicants, Named Respondents, and Impact on Melaka Election Operations

The judicial review application involves key party leaders across the coalition and highlights upcoming electoral constraints:

  • Coalition Applicants: The judicial review application was jointly filed on October 5, 2026, by PN Secretary-General Datuk Seri Takiyuddin Hassan, Parti Gerakan Rakyat Malaysia (Gerakan) Secretary-General Wong Chia Zhen, and Malaysian Indian People’s Party (MIPP) Secretary-General N. Sathes Kumar. They were joined by Parti Wawasan Negara (Wawasan) Secretary-General Datuk Seri Saifuddin Abdullah and Parti Pejuang Tanahair (Pejuang) Secretary-General Datuk Sazmi Miah.
  • Named Respondents: The suit names ROS Director-General Datuk Mohd Zulfikar Ahmad and Home Minister Datuk Seri Saifuddin Nasution Ismail as respondents.
  • Impact on Melaka State Election: In a certificate of urgency filed alongside the application through law firm Messrs Siddiq Azani & Co, the applicants stated that the active suspension order prevents the coalition from conducting routine political operations, including utilizing PN’s official name and logo in the 16th Melaka State Election.

The High Court will hear the inter partes stay application on October 22 to determine if the suspension will be temporarily halted pending the judicial review outcome.
