PUTRAJAYA, Sept 4 — The prosecution will appeal to the Federal Court against a Court of Appeal ruling that allowed Datin Seri Rosmah Mansor to adduce additional evidence in her appeal against her conviction and sentence in the RM1.25 billion solar hybrid project corruption case.
Attorney-General Tan Sri Mohd Dusuki Mokhtar confirmed that the prosecution would file the notice of appeal as soon as possible, within the required 14-day statutory timeframe.
“It merits an appeal to the Federal Court. We will file it as soon as possible,” Mohd Dusuki said when contacted today.
On Tuesday, a three-man Court of Appeal bench comprising Justices Datuk Azhahari Kamal Ramli, Datuk Dr Choo Kah Sing, and K. Muniandy granted Rosmah’s application to submit additional evidence. The bench ordered that the evidence be recorded from prosecution witness Rayyan Radzwill Abdullah through further cross-examination and re-examination before a new High Court judge within two weeks following case management set for Sept 10.
Rosmah sought to adduce a police report and a statutory declaration affirmed by Rayyan, who alleged that he had been subjected to prosecutorial pressure during the original trial.
The wife of former Prime Minister Datuk Seri Najib Razak was convicted by the High Court on Sept 1, 2022, on three corruption charges under Section 16(a)(A) of the MACC Act 2009 for soliciting RM187.5 million and receiving RM6.5 million in bribes to assist Jepak Holdings Sdn Bhd in securing the solar hybrid project for 369 rural schools in Sarawak. She was sentenced to 10 years’ imprisonment on each count, to run concurrently, and fined RM970 million.
The Court of Appeal has fixed Oct 4 to 16 and Oct 19 to 23 to hear her main appeal.
