Datuk Seri Mohd Shuhaily Mohd Zain
KOTA BHARU, Oct 31 – The Attorney-General’s Chambers (AGC) has confirmed that it did not interfere in the decision to return former Border Control and Protection Agency (AKPS) Director-General Datuk Seri Mohd Shuhaily Mohd Zain to the Royal Malaysia Police (PDRM).
Attorney-General Tan Sri Mohd Dusuki Mokhtar stated on Saturday, October 31, 2026, that his office serves purely as a legal advisory body and that decisions regarding Shuhaily’s posting remain entirely an administrative matter under the Home Ministry (KDN).
Speaking to reporters following the handover of the AGC Kampung Angkat MADANI (KAM) 2026 infrastructure in Kota Bharu, Kelantan, Mohd Dusuki clarified that the AGC issued no official legal opinion on the reassignment as the matter was not formally referred to them.
“We have not given an official opinion because it has not been referred to AGC, it is just an administrative action by KDN, so we will not interfere in that,” Mohd Dusuki explained. “Whether Datuk Mohd Shuhaily wants to stay there or be transferred back to the PDRM… that is more of an administrative matter.”
The Attorney-General’s comments follow an announcement on Thursday by Home Minister Datuk Seri Saifuddin Nasution Ismail, who confirmed that Shuhaily had returned to duty with PDRM following a decision finalized the previous week.
The reassignment sparked public attention after former police constable Saifuddin Abdul Kader, through his legal team, requested AGC intervention to re-open a 2015 assault report lodged against Shuhaily during his tenure as Hilir Perak District Police Chief.
Addressing separate institutional reforms, Mohd Dusuki revealed that the AGC is currently drafting proposed framework provisions on candidate selection methods to facilitate the separation of powers between the Public Prosecutor and the Attorney General.
The legal drafting follows a two-week timeline set by Minister in the Prime Minister’s Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said for the AGC to submit feedback to the Parliamentary Special Select Committee (PSSC).
Administrative Framework, Legal Disputes, and Public Prosecutor Reforms
Key administrative developments, legal background, and institutional reform updates include:
- Scope of AGC Involvement: AG confirms Shuhaily’s reassignment is an internal KDN administrative matter without direct AGC interference.
- 2015 Assault Report: Reassignment context involves a request from former policeman Saifuddin Abdul Kader for the AGC to re-open a 2015 assault investigation against Shuhaily.
- Public Prosecutor Role Separation: AGC actively drafting provisions on selection frameworks following Azalina Othman Said’s two-week timeline directive to brief the PSSC.
