Teenager With Disabilities Ordered to Undergo Psychiatric Evaluation Over Death of Disabled Mother

KUALA KANGSAR, Sept 30 – The Kuala Kangsar Magistrates’ Court has ordered a 15-year-old boy with multiple disabilities, accused of causing the death of his disabled mother, to undergo a psychiatric examination at Hospital Bahagia Ulu Kinta.

Magistrate Azlin Zeti Zainal Abidin issued the evaluation order after observing that the teenager had a history of mental illness and was unable to comprehend the charge read to him in court.

According to the charge sheet, the youth is accused of committing an act with the intent to cause death that resulted in the demise of 49-year-old Nor Ainon Omar, committing culpable homicide not amounting to murder.

The incident allegedly occurred at a residence in Kampung Cheh Kati, Kuala Kangsar, around 2:10 PM on September 23.

The charge was framed under Section 304(a) of the Penal Code, which carries a maximum penalty of 30 years’ imprisonment and a possible fine upon conviction.

During proceedings, Deputy Public Prosecutor Nur Mirza Zulaikha Mohd Fadzly applied for the unrepresented teenager to be referred for medical evaluation. When Magistrate Azlin Zeti asked the accused who accompanied him to court, the teenager remained silent.

“As the court has been informed that the accused has a mental health record, I will not record any plea. The court issues an order for him to be sent to Hospital Bahagia Ulu Kinta for examination under Section 342 of the Criminal Procedure Code,” Magistrate Azlin Zeti ruled.

The court set October 22 for case mention and the submission of the psychiatric report.

On September 23, the 49-year-old victim was found dead in a pool of blood in her living room. Following initial investigations, police remanded the victim’s 44-year-old husband for seven days and the teenager for two days.
