Soldier Charged With Abusing Five-Year-Old Daughter in Kota Bharu

KOTA BHARU, Sept 17 — A 40-year-old armed forces member was charged in the Sessions Court here today with physically abusing his five-year-old daughter by kicking her at an eatery last week.

The accused, Mohamed Nisa Mohamed Nasir, pleaded not guilty to the charge after it was read out before Judge Zulkifli Abllah.

According to the charge sheet, Mohamed Nisa allegedly kicked the young girl at an eatery located at Lot 143, Batu 2, Jalan Kuala Krai, at approximately 10:55 pm on Sept 11, 2026.

The charge was framed under Section 31(1)(a) of the Child Act 2001, which is punishable under Section 31(1) of the same Act. If convicted, he faces a fine of up to RM50,000, an imprisonment term of up to 20 years, or both.

During proceedings, the prosecution requested that no bail be offered, citing concerns that the accused could interfere with prosecution witnesses, specifically the victim, who is his biological daughter.

In pleading for bail, the defence submitted that Mohamed Nisa has served in the military for 19 years and is the father of three children. Counsel further informed the court that the accused’s unemployed wife requires regular haemodialysis treatment and relies on him for hospital visits. The defence added that the accused has no prior record of domestic violence and poses no flight risk due to military unit oversight.

Judge Zulkifli granted bail at RM10,000 with one local surety. The court imposed strict conditions requiring the accused to refrain from contacting or interfering with prosecution witnesses—particularly the victim—surrender his passport, and report to the Pengkalan Chepa Police Station or nearest police station every two weeks until the conclusion of the case.

The court fixed Oct 22 for case mention for the submission of documents.
