Former Executives of Tabung Haji Subsidiary THP Bina Charged with CBT, Abetment Involving RM72,000

KUALA LUMPUR, Sept 3 — A former Health and Safety Manager of THP Bina Sdn Bhd and a former Deputy General Manager of TH Properties Sdn Bhd were charged in separate Sessions Courts today over criminal breach of trust (CBT) and abetment involving RM72,000 in penalty funds linked to a Putrajaya development project.

Nasahruddin Ahmad, 56, pleaded not guilty before Judge Rosli Ahmad to three counts of CBT under Section 409 of the Penal Code. He is accused of depositing RM72,000 in penalty funds collected from contractor Fourth Wave Sdn Bhd for an office complex project in Precinct 3, Putrajaya, into his personal bank account between April 26, 2013, and Aug 12, 2015.

THP Bina is a wholly owned subsidiary of TH Properties Sdn Bhd, an investment and project management arm of Lembaga Tabung Haji. Section 409 carries a maximum penalty of 20 years’ imprisonment, whipping, and a fine upon conviction.

In a separate court before Judge Azura Alwi, former TH Properties and THP Bina Deputy General Manager Tengku Kamarolhisham Tengku Kamaruddin, 55, pleaded not guilty to three counts of abetting Nasahruddin. Tengku Kamarolhisham is alleged to have instructed Nasahruddin to deposit the penalty funds into the latter’s personal bank account. The abetment charges were brought under Section 109 of the Penal Code, read together with Section 409.

“My client was not arrested in connection with this case. Instead, he voluntarily presented himself at the Malaysian Anti-Corruption Commission (MACC) headquarters in Putrajaya and fully cooperated with the agency,” defense counsel Muhammad Naqib Aiman Mohd Faizal argued, noting that the funds involved private settlement money from a contractor dispute rather than public funds.

Judge Azura granted Tengku Kamarolhisham bail at RM45,000 with one surety, ordering the surrender of his passport and issuing a prohibition against interfering with prosecution witnesses. The court fixed Oct 5 for case mention.

The court actions follow ongoing enforcement proceedings linked to the Royal Commission of Inquiry (RCI) report on Lembaga Tabung Haji, under which 11 individuals—including former high-ranking executives and a former minister—were previously remanded by the MACC.
