AGC Clarifies Decision to Drop Four Charges Against Muhyiddin Yassin Based on Evidential Assessment

KUALA LUMPUR, Sept 15 — The Attorney General’s Chambers (AGC) today stated that its decision to discontinue four charges against Tan Sri Muhyiddin Yassin in relation to Bukhary Equity Sdn Bhd was made following a comprehensive professional assessment of the evidence, case viability, and overall prosecution strategy.

The AGC clarified that the decision to drop the single abuse of power charge and three money laundering charges—totaling RM200 million—does not mean the charges were brought without basis, nor should it be interpreted as a finding that the underlying transactions did not occur.

According to the AGC, prosecutorial decisions must be continuously reviewed regarding evidence admissibility, witness credibility, and potential impacts on related proceedings. Proceeding with the four charges presented a tangible risk of undermining the strategy and evidential foundation of the remaining charges facing the former prime minister.

“In such circumstances, the prosecution must consider the overall interests of the case rather than defend one charge in isolation,” the AGC said in a statement. “The duty of the prosecution is not to defend a particular charge at all costs, but to ensure that only charges supported by sufficient evidence and capable of being defended in court are pursued.”

The statement reaffirmed that the prosecution will proceed with three remaining predicate charges under Section 23(1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 against Muhyiddin. These charges involve allegedly using his position to obtain RM25.3 million in bribes for Bersatu from Nepturis Sdn Bhd, Mamfor Sdn Bhd, KCJ Engineering Sdn Bhd, and Datuk Seri Azman Yusoff in connection with the Jana Wibawa project.

The AGC’s clarification follows High Court Judge Noor Ruwena Md Nurdin’s ruling earlier today to discharge and acquit the 79-year-old Pagoh Member of Parliament of the four Bukhary Equity-related charges. The prosecution officially closed its case today after calling 29 witnesses throughout the trial.
