{"id":9632,"date":"2021-05-24T11:57:50","date_gmt":"2021-05-24T03:57:50","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=9632"},"modified":"2021-05-24T11:57:51","modified_gmt":"2021-05-24T03:57:51","slug":"mco-sop-not-static-but-dynamic-muhyiddin","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=9632","title":{"rendered":"MCO SOP not static but dynamic &#8211; Muhyiddin"},"content":{"rendered":"\n<p>KUALA LUMPUR, May 24 &#8212; The Movement Control Order (MCO) standard\u00a0operating procedures (SOP) issued by the National Security Council (MKN) are not static,\u00a0instead, they are dynamic, and the decision to whether or not to impose the lockdown is\u00a0made according to the current COVID-19 pandemic situation.<\/p>\n\n\n\n<p>Prime Minister Tan Sri Muhyiddin Yassin said he was aware of the grievances of the people upon seeing the changes in the SOP, but it was indeed due to changes in&nbsp;the situation of COVID-19 itself.<\/p>\n\n\n\n<p>\u201cThey are not static (in regard to the MCO SOP). They are dynamic. They follow the situation&nbsp;that requires us to make adjustments to deal with different situations. For example,&nbsp;(previously) restaurants were allowed to have dine-in customers. Then they were disallowed&nbsp;(from doing so).<\/p>\n\n\n\n<p>\u201cI\u2019m sorry if there are those who feel confused. The National Security Council (MKN)\u00a0determines the SOP. They are not being decided by any one person. They are decided via\u00a0discussion. The MKN did not decide on the SOP arbitrarily,\u201d he said in a\u00a0\u201cSpecial\u00a0Discussion on the Challenges of COVID-19 with the\u00a0Prime Minister\u201d broadcast over RTM and Bernama TV tonight.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-24-at-11.54.10.png\" alt=\"static\" class=\"wp-image-9633\" width=\"429\" height=\"230\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-24-at-11.54.10.png 590w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-24-at-11.54.10-300x161.png 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-24-at-11.54.10-186x100.png 186w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-24-at-11.54.10-350x188.png 350w\" sizes=\"auto, (max-width: 429px) 100vw, 429px\" \/><\/figure><\/div>\n\n\n\n<p>The Prime Minister also stressed that the implementation of the SOP was decided in a&nbsp;meeting&nbsp;which was also attended by the Attorney-General with Senior Minister (Security&nbsp;Cluster), Datuk Seri Ismail Sabri Yaakob, to study the SOP, which will then be gazetted&nbsp;before being enforced and announced, so that all parties will be made aware.<\/p>\n\n\n\n<p>\u201cIf you don\u2019t understand, you can ask. We have asked the ministers to give an explanation&nbsp;as well as the officials to provide an explanation. Community leaders handling&nbsp;empowerment programmes have also been provided with the information so that they can&nbsp;help explain the situation and circumstances,\u201d he said.<\/p>\n\n\n\n<p>Muhyiddin also explained that the state governments did not have the power to request to change the SOP as the power rested with the federal government, under the Prevention and&nbsp;Control of Infectious Diseases Act 1988 (Act 342) under the Ministry of Health; and the&nbsp;Workers\u2019 Minimum Standards of Housing and Amenities Act 1990 (Act 446) under the Ministry of Human Resources.<\/p>\n\n\n\n<p>On non-compliance with the SOP, the Prime Minister said that every action taken must be&nbsp;based on the law, if what happened was the opposite, a person subject to SOP action could&nbsp;challenge it.<\/p>\n\n\n\n<p>\u201cIf someone commits an offence, we (the government) want to take action for the individual\u00a0to be punished. Like the current cases. It could be a celebrity, could be anyone. I do not\u00a0want to mention the name, the action must be based on the law.<\/p>\n\n\n\n<p>\u201cThe power to arrest or impose a compound of RM10,000? That is why the SOP are based&nbsp;on the law and gazetted. If they are not gazetted, they are not valid. This is something that&nbsp;not many people are aware of. That is why if the government decides to formulate the SOP,&nbsp;as long as they are not gazetted they cannot be enforced,\u201d he said.<\/p>\n\n\n\n<p>\u201cThe government does not care who (the individuals are), from ministers to the prime&nbsp;minister, who violate (the SOP).
