{"id":9471,"date":"2021-05-11T21:11:18","date_gmt":"2021-05-11T13:11:18","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=9471"},"modified":"2021-05-11T21:14:29","modified_gmt":"2021-05-11T13:14:29","slug":"sri-ram-to-defend-himself-against-rosmahs-bid-to-disqualify-him-court-told","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=9471","title":{"rendered":"Sri Ram to defend himself against Rosmah\u2019s bid to disqualify him, court told"},"content":{"rendered":"\n<p>KUALA LUMPUR, May 11&nbsp;&#8212; The High Court&nbsp;was told that former Federal Court Judge Datuk Seri Gopal Sri Ram will&nbsp;argue&nbsp;personally against Datin Seri Rosmah&#8217;s application to disqualify him as the lead prosecutor in her corruption trial linked to the RM1.25 billion solar hybrid project for 369 rural schools in Sarawak.<\/p>\n\n\n\n<p>The matter was informed by deputy public prosecutor (DPP) Mohamad Mustafa P Kunyalam during case management before&nbsp;Judge Mohamed Zaini Mazlan today.<\/p>\n\n\n\n<p>\u201cMy Lord, Datuk Seri Sri Ram himself will lead the submissions because he said this affects him personally, so he will come and submit, that is my instruction,\u201d&nbsp;said the DPP.<\/p>\n\n\n\n<p>To this, counsel Datuk Jagjit Singh, who leads Rosmah\u2019s legal team stood up and objected to&nbsp;it, saying&nbsp;that&nbsp;there was no locus&nbsp;standi for Sri Ram to do so.<\/p>\n\n\n\n<p>\u201cSri Ram cannot argue on his own cause, although this is not a judge in his own cause, it affects him personally. It will become&nbsp;a mockery. This is highly improper and coming from an ex-judge, he should know better,\u201d&nbsp;said Jagjit.<\/p>\n\n\n\n<p>Mohamad Mustafa further cited the case of Datuk Seri Anwar Ibrahim, whereby Tan Sri Muhammad Shafee Abdullah&#8217;s appointment as a DPP was challenged and he (Muhammad Shafee) appeared himself to defend&nbsp;his appointment.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-11-at-21.08.02.png\" alt=\"Rosmah's\" class=\"wp-image-9472\" width=\"502\" height=\"272\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-11-at-21.08.02.png 580w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-11-at-21.08.02-300x162.png 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-11-at-21.08.02-185x100.png 185w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-11-at-21.08.02-350x189.png 350w\" sizes=\"auto, (max-width: 502px) 100vw, 502px\" \/><\/figure><\/div>\n\n\n\n<p>\u201cWe are guided by Datuk Seri Anwar Ibrahim\u2019s case, Muhammad Shafee was asked to be disqualified, he submitted on his own, there was no issue, it was decided by a Federal Court judge,\u201d&nbsp;he added.<\/p>\n\n\n\n<p>Rosmah\u2019s other lawyer Datuk Akberdin Abdul Kader&nbsp;replied that&nbsp;there was no issue about the fiat in Muhammad Shafee\u2019s appointment as DPP.<\/p>\n\n\n\n<p>\u201cBut here, the fiat&nbsp;(in Sri Ram\u2019s appointment) is being challenged. He doesn&#8217;t have locus standi&nbsp;as far as the matter is concerned,\u201d said the lawyer.<\/p>\n\n\n\n<p>Muhammad Shafee, a senior lawyer, was appointed by the Attorney-General by fiat (authorisation) under Section 376 (3) of the Criminal Procedure Code (CPC) and Article 145 (3) of the Federal Constitution to conduct the appeal in&nbsp;&nbsp;Anwar\u2019s case.<\/p>\n\n\n\n<p>Judge Mohamed Zaini&nbsp;then asked both parties to resolve&nbsp;the issue before the hearing of the application.<\/p>\n\n\n\n<p>\u201cI don&#8217;t want any technical issues raised during the hearing. Please think about this matter,\u201d&nbsp;the judge said and&nbsp;fixed June 3 to hear Rosmah\u2019s&nbsp;application.&nbsp;<\/p>\n\n\n\n<p>Last Thursday, Rosmah, 69, had filed two applications at the High Court here seeking to nullify her entire trial, in her bid to be acquitted of all three charges and seeking once again to remove Sri Ram as the lead prosecutor in her trial.<\/p>\n\n\n\n<p>The application was filed after the Court of Appeal, on April 8,&nbsp;allowed Rosmah\u2019s appeal to obtain a copy of Sri Ram&#8217;s appointment letter, after the prosecution conceding to provide it to the defence team.<\/p>\n\n\n\n<p>Rosmah brought the matter up for appeal after the High Court dismissed her application for Sri Ram\u2019s appointment letter on Aug 19 last year.<\/p>\n\n\n\n<p>The appointment letter was not dated on or before Nov 15, 2018, the day when Rosmah was charged in court, and was not signed by the&nbsp;then Attorney-General Tan Sri Tommy Thomas.
