{"id":6228,"date":"2020-10-05T20:07:36","date_gmt":"2020-10-05T12:07:36","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=6228"},"modified":"2020-10-05T20:07:39","modified_gmt":"2020-10-05T12:07:39","slug":"nfc-trial-governments-suit-against-nfc-postponed","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=6228","title":{"rendered":"NFC Trial: government&#8217;s suit against NFC postponed"},"content":{"rendered":"\n<p>KUALA LUMPUR, Oct&nbsp;5 &#8212; The trial of the Malaysian Government\u2019s suit against National Feedlot Corporation (NFC)&nbsp;which had been fixed for today until Thursday at the High Court here&nbsp;has been postponed as Senior Federal Counsel Azizan Md Arshad&nbsp;is undergoing COVID-19&nbsp;home quarantine.<\/p>\n\n\n\n<p>In the suit, NFC as one of the defendants is&nbsp;required to repay&nbsp;RM253.6 million&nbsp;in loan and interest&nbsp;for the setting up and operation of a national feedlot centre in Gemas, Negeri Sembilan.<\/p>\n\n\n\n<p>Laywer&nbsp;Datuk K.Kirubakaran representing the defendants said&nbsp;the plaintiff had applied for the trial to be postponed as Azizan had to undergo 14-day quarantine following his return from Sabah after attending a case in the&nbsp;Kota Kinabalu Court.<\/p>\n\n\n\n<p>\u201cJudicial Commissioner Anand Ponnudurai allowed the&nbsp;application&nbsp;and set Nov 4 to 6 Nov and Feb 22 to 26, 2021 for the hearing to continue,\u201d&nbsp;he said when met by reporters&nbsp;after the proceeding&nbsp;in Anand&#8217;s&nbsp;chambers today.<\/p>\n\n\n\n<p>Also present was Federal Counsel Mohd Ashraf Abd Hamid, acting&nbsp;on behalf of the Malaysian Government.<\/p>\n\n\n\n<p>Kirubakaran said\u00a0the defence\u00a0would\u00a0call five witnesses to testify.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/10\/92263fc127c374dcde9d4a77953e93185f7adb9ca1626-1024x555.jpg\" alt=\"nfc\" class=\"wp-image-6229\" width=\"462\" height=\"250\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/10\/92263fc127c374dcde9d4a77953e93185f7adb9ca1626-1024x555.jpg 1024w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/10\/92263fc127c374dcde9d4a77953e93185f7adb9ca1626-300x163.jpg 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/10\/92263fc127c374dcde9d4a77953e93185f7adb9ca1626-768x416.jpg 768w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/10\/92263fc127c374dcde9d4a77953e93185f7adb9ca1626-184x100.jpg 184w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/10\/92263fc127c374dcde9d4a77953e93185f7adb9ca1626-350x190.jpg 350w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/10\/92263fc127c374dcde9d4a77953e93185f7adb9ca1626-800x434.jpg 800w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/10\/92263fc127c374dcde9d4a77953e93185f7adb9ca1626.jpg 1079w\" sizes=\"auto, (max-width: 462px) 100vw, 462px\" \/><\/figure><\/div>\n\n\n\n<p>The trial began on Jan 13 with five plaintiff witnesses completed giving their evidence, while the last witness, an&nbsp;auditor of a private company, has yet to be called to testify.<\/p>\n\n\n\n<p>NFC&nbsp;is managed&nbsp;by the husband and three children of former women, family and community development minister&nbsp;Tan Sri Shahrizat Abdul Jalil.<\/p>\n\n\n\n<p>In its claim, the government as&nbsp;the sole plaintiff, named the NFC as the first defendant, while Shahrizat\u2019s&nbsp;husband, Datuk Dr Mohamad Salleh Ismail,&nbsp;and their three children,&nbsp;Wan Shahinur Izran, Wan Shahinur Izmir and Wan Izzana Fatimah Zabedah, are the second to fifth defendant,&nbsp;respectively.<\/p>\n\n\n\n<p>Other defendants are six companies controlled by Mohamad&nbsp;Salleh\u2019s&nbsp;family, comprising&nbsp;National Meat &amp; Livestock Corporation Sdn Bhd,&nbsp;Real Food Corporation Sdn&nbsp;Bhd,&nbsp;Meatworks Corporation Sdn&nbsp; Bhd,&nbsp;Agroscience Industries Sdn Bhd,&nbsp;Asian Bioscience Corporation Sdn Bhd,&nbsp;and&nbsp;Techknowlogy Imageware (M) Sdn Bhd.<\/p>\n\n\n\n<p>The government entered into an agreement with NFC on Dec 6, 2007&nbsp;for a&nbsp;RM250&nbsp;million loan, a portion of which was used to&nbsp;fund the establishment and operations of the National Feedlot Centre, in line with the government\u2019s policy to develop and advance beef production and beef products.&nbsp;<\/p>\n\n\n\n<p>The loan was disbursed by the government to NFC in three tranches.<\/p>\n\n\n\n<p>Mohamad Salleh\u2019s family made 10 withdrawals totalling&nbsp;RM180.51 million&nbsp;from Jan 24, 2008 to Jan 3, 2011.&nbsp;<\/p>\n\n\n\n<p>Of the&nbsp;RM180.51 million withdrawn, only RM8.32 million was paid directly to third parties to conduct the National Feedlot Centre project. The balance of the withdrawn funds was transferred to other NFC accounts and a total of RM118.04 million from this balance&nbsp;was allegedly misused.<\/p>\n\n\n\n<p>Included in the alleged misuse of funds is a total of RM9.76 million which was allegedly used to&nbsp;purchase one of two units at One Menerung Residence.
