{"id":5595,"date":"2020-08-21T13:45:39","date_gmt":"2020-08-21T05:45:39","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=5595"},"modified":"2020-08-21T13:45:42","modified_gmt":"2020-08-21T05:45:42","slug":"sabah-court-dismisses-application-over-state-assembly-dissolution","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=5595","title":{"rendered":"Sabah Court dismisses application over State Assembly dissolution"},"content":{"rendered":"\n<p>KOTA KINABALU, Aug 21 &#8212; The High Court today dismissed an application by 33 assemblymen for leave for a judicial review of the decision of the Yang Dipertua Negeri in the dissolution of the state legislative assembly on July 30.<\/p>\n\n\n\n<p>Judicial Commissioner Leonard David Shim found that the second respondent in the case &#8211; Sabah Chief Minister Datuk Seri Mohd Shafie Apdal &#8211; had acted within the Sabah Constitution in requesting the first respondent &#8211; Sabah Yang Dipertua Tun Juhar Mahiruddin &#8211; to dissolve the state assembly.<\/p>\n\n\n\n<p>&#8220;And the first respondent (Tun Juhar) had acted within the ambit of his constitutional power\u00a0to dissolve the state assembly,&#8221; he said when ruling on the matter today.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/08\/e2b81af2ff8835cdca72a24a446e79195f3891f1eab34-1024x556.jpg\" alt=\"dissolution\" class=\"wp-image-5596\" width=\"497\" height=\"269\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/08\/e2b81af2ff8835cdca72a24a446e79195f3891f1eab34-1024x556.jpg 1024w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/08\/e2b81af2ff8835cdca72a24a446e79195f3891f1eab34-300x163.jpg 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/08\/e2b81af2ff8835cdca72a24a446e79195f3891f1eab34-768x417.jpg 768w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/08\/e2b81af2ff8835cdca72a24a446e79195f3891f1eab34-184x100.jpg 184w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/08\/e2b81af2ff8835cdca72a24a446e79195f3891f1eab34-350x190.jpg 350w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/08\/e2b81af2ff8835cdca72a24a446e79195f3891f1eab34-800x434.jpg 800w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2020\/08\/e2b81af2ff8835cdca72a24a446e79195f3891f1eab34.jpg 1091w\" sizes=\"auto, (max-width: 497px) 100vw, 497px\" \/><\/figure><\/div>\n\n\n\n<p>Almost immediately after the ruling was handed down, the 33 assemblymen filed an appeal against the High Court decision.<\/p>\n\n\n\n<p>The 33 assemblymen are led by former chief minister Tan Sri Musa Aman, who is the assemblyman for Sungai Sibuga.<\/p>\n\n\n\n<p>Shim also said that the proclamation to dissolve the state assembly was constitutional and valid.<\/p>\n\n\n\n<p>In announcing&nbsp;the&nbsp;ruling today, he said the court looked into the substance rather than the form of the written request (letter by Mohd Shafie to Tun Juhar to dissolve the assembly).<\/p>\n\n\n\n<p>The 33 applicants&#8217; contention is that the letter was invalid and incapable of invoking the Yang Dipertua Negeri&#8217;s power to dissolve the state assembly, and therefore it was&nbsp;<em>ultra vires<\/em>&nbsp;the Sabah Constitution and justiciable.<\/p>\n\n\n\n<p>However, Shim said he found that the decision to dissolve the state assembly and the proclamation were not amenable to a judicial review, thus non-justiciable.<\/p>\n\n\n\n<p>The judicial commissioner also found that the 33 applicants had&nbsp;<em>locus standi&nbsp;<\/em>in that they had a real and genuine interest in the matter (Tun Juhar&#8217;s decision to dissolve the assembly).<\/p>\n\n\n\n<p>&#8220;After considering the affidavits, written and oral submissions (by the applicants&#8217; counsel), the applicants have met the threshold of&nbsp;<em>locus standi,\u201d&nbsp;<\/em>he said.<\/p>\n\n\n\n<p>The applicants were represented by a team of lawyers led by Tengku Fuad Ahmad, while Tun Juhar, Mohd Shafie and the third respondent, the Government of Sabah, were represented by Sabah Attorney-General Brenndon Keith Soh. Senior Federal Counsel Suzana Atan and S.
