{"id":16382,"date":"2023-02-20T16:04:44","date_gmt":"2023-02-20T08:04:44","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=16382"},"modified":"2023-02-20T16:04:45","modified_gmt":"2023-02-20T08:04:45","slug":"why-the-hurry-to-hear-najibs-appeal-shafee-abdullah","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=16382","title":{"rendered":"Why the &#8216;hurry&#8217; to hear Najib&#8217;s appeal &#8211; Shafee Abdullah"},"content":{"rendered":"\n<p><strong>PUTRAJAYA, Feb 20<\/strong> &#8212; The Federal Court was today told that Datuk Seri Najib Tun Razak&#8217;s former counsel Datuk Hisyam Teh Poh Teik was \u201cforced\u201d to continue to represent the former premier in his main SRC International Sdn Bhd\u2019s appeal, despite the lawyer\u2019s request to be discharged.\u00a0<\/p>\n\n\n\n<p>Najib&#8217;s lead counsel, Tan Sri Muhammad Shafee Abdullah submitted that Hisyam had&nbsp;informed the court on Aug 18, 2022, of his wish&nbsp;to discharge himself in the SRC International appeal on grounds that he did&nbsp;not have sufficient time to prepare.<\/p>\n\n\n\n<p>On July 26 last year, Najib discharged with immediate effect&nbsp;&nbsp;Messrs Shafee &amp; Co from representing him in his SRC appeal and appointed Hisyam, from Messrs Hisyam Teh, as his lead counsel and ZIST partners, &nbsp;Liew Teck Huat and Rueben Mathiaravanam as co-counsels.<\/p>\n\n\n\n<p>Hisyam previously sought to postpone the case for three to four months for him to prepare,\u00a0but it was dismissed.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2018\/09\/Shafee-abdullah-1-1-e1537248418869.jpg\" alt=\"appeal\" class=\"wp-image-653\" width=\"602\" height=\"533\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2018\/09\/Shafee-abdullah-1-1-e1537248418869.jpg 960w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2018\/09\/Shafee-abdullah-1-1-e1537248418869-300x266.jpg 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2018\/09\/Shafee-abdullah-1-1-e1537248418869-768x681.jpg 768w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2018\/09\/Shafee-abdullah-1-1-e1537248418869-113x100.jpg 113w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2018\/09\/Shafee-abdullah-1-1-e1537248418869-350x310.jpg 350w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2018\/09\/Shafee-abdullah-1-1-e1537248418869-800x709.jpg 800w\" sizes=\"auto, (max-width: 602px) 100vw, 602px\" \/><\/figure><\/div>\n\n\n<p>Following that, Muhammad Shafee said Hisyam sought to discharge himself from representing Najib and the court also denied the&nbsp;request.<\/p>\n\n\n\n<p>\u201cIt was a forced representation by an ineffective counsel&nbsp;who was not prepared. It was a representation by \u2018pretense\u2019, supervised by the Federal Court. This right was an illusory right in this case,\u201d he added.<\/p>\n\n\n\n<p>The lawyer also said&nbsp;the refusal to postpone the hearing left Hisyam \u201cunduly shackled\u201d&nbsp;when representing Najib as it left him with insufficient time to prepare.<\/p>\n\n\n\n<p>\u201cNajib\u2019s personal liberty was very much at stake because he had a 12-year imprisonment sentence hanging over his head and an unprecedented colossal fine of RM210 million.<\/p>\n\n\n\n<p>\u201cThe court also did not allow my client\u2019s application for adjournment of the main appeal hearing. In the case of some others, the court allows 70 times adjournment, but why couldn&#8217;t my client get it once?<\/p>\n\n\n\n<p>\u201cWhy so hurry? Was it because the 15th General Election was around the corner?
