{"id":15338,"date":"2022-10-27T14:16:01","date_gmt":"2022-10-27T06:16:01","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=15338"},"modified":"2022-10-27T14:16:02","modified_gmt":"2022-10-27T06:16:02","slug":"court-dismisses-najibs-bid-to-attend-parliament-as-its-now-academic-has-no-merit","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=15338","title":{"rendered":"Court dismisses Najib&#8217;s bid to attend Parliament as it&#8217;s now academic, has no merit"},"content":{"rendered":"\n<p><strong>KUALA LUMPUR, Oct 27<\/strong> &#8212; The High Court here today dismissed Datuk Seri Najib Tun Razak&#8217;s legal challenge over the Prisons Department\u2019s refusal to allow his request to attend Dewan Rakyat proceedings.<\/p>\n\n\n\n<p>Judge Datuk Ahmad Kamal Md Shahid ruled that there is no live issue to be considered&nbsp;by the&nbsp;court as Najib is no longer a Member of Parliament after the dissolution of Parliament on Oct 10.<\/p>\n\n\n\n<p><em>\u201cUpon the dissolution of Parliament, the applicant (Najib) ceased to be a Member of Parliament. Unless and until the pardon is given or the conviction is quashed\u00a0upon review, there is no possibility that the applicant will again be a Member of Parliament while simultaneously being a prisoner, as the law prohibits any convicted person to contest for election by virtue of Article 48(5) of the Federal Constitution.&#8221;<\/em><\/p>\n\n\n\n<p><em>\u201cTherefore, the application is now academic and has no merit.&#8221;<\/em><\/p>\n\n\n\n<p><em>\u201cI hereby\u00a0dismiss\u00a0the application for being frivolous and vexations,\u201d<\/em>\u00a0the judge said.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/06\/FW1243089_KL03_16062022_1MDB_NAJIB-lpr-1024x810.jpg\" alt=\"attend\" class=\"wp-image-14152\" width=\"615\" height=\"486\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/06\/FW1243089_KL03_16062022_1MDB_NAJIB-lpr-1024x810.jpg 1024w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/06\/FW1243089_KL03_16062022_1MDB_NAJIB-lpr-300x237.jpg 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/06\/FW1243089_KL03_16062022_1MDB_NAJIB-lpr-768x607.jpg 768w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/06\/FW1243089_KL03_16062022_1MDB_NAJIB-lpr-126x100.jpg 126w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/06\/FW1243089_KL03_16062022_1MDB_NAJIB-lpr-350x277.jpg 350w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/06\/FW1243089_KL03_16062022_1MDB_NAJIB-lpr-800x633.jpg 800w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/06\/FW1243089_KL03_16062022_1MDB_NAJIB-lpr.jpg 1280w\" sizes=\"auto, (max-width: 615px) 100vw, 615px\" \/><\/figure><\/div>\n\n\n<p>On Oct 5, Najib&nbsp;filed the application for leave for judicial review to challenge the Prisons Department\u2019s refusal to allow his request to attend the Dewan Rakyat sitting.<\/p>\n\n\n\n<p>In his lawsuit, Najib&nbsp;named&nbsp;the Malaysian Government, the Minister of Home Affairs and the Commissioner General of Prisons as the first to third respondents, and sought an order to quash the decision of the third respondent to not allow him access to his officers\/aides for the purposes of parliamentary, legislative and constituency&nbsp;work.<\/p>\n\n\n\n<p>Judge Ahmad Kamal in his brief judgment said as Najib&nbsp;is no longer the Pekan MP, the declaratory reliefs sought by him&nbsp;to have access to his officers\/aides for the purposes of parliamentary, legislative and constituency work as well as to have access and attendance in Parliament on scheduled dates of session\/sitting is also no longer a live issue.<\/p>\n\n\n\n<p>In fact, he said the declaratory reliefs sought by Najib have become impossible with the dissolution of the Parliament since there is no Parliament&nbsp;for him to attend.&nbsp;<\/p>\n\n\n\n<p><em>\u201cOn top of that, the Election Commission had also announced that the polling day for the next General Election to be on Nov 19. That would mean another Cabinet will be formed consisting of newly elected Members of Parliament,\u201d<\/em>\u00a0the judge said.<\/p>\n\n\n\n<p>He stated that the argument put forward by the&nbsp;applicant\u2019s counsel that \u201cat the time of filing, it is a live issue\u201d&nbsp;is of no merit.&nbsp;<\/p>\n\n\n\n<p>\u201cThis is because it is logical that when any application is made or filed before the court, the issue is a live issue&nbsp;to be considered at the time of filing.<\/p>\n\n\n\n<p>\u201cHowever, the matter has now been overtaken by events with the dissolution of the Parliament. The issue in question has now become water under the bridge and is no longer in existence.
