{"id":15288,"date":"2022-10-22T17:05:32","date_gmt":"2022-10-22T09:05:32","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=15288"},"modified":"2022-10-22T17:05:34","modified_gmt":"2022-10-22T09:05:34","slug":"thomas-bar-council-declined-to-cooperate-in-probe-stf","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=15288","title":{"rendered":"Thomas, Bar Council declined to cooperate in probe  &#8211; STF"},"content":{"rendered":"\n<p><strong>KUALA LUMPUR, Oct 22<\/strong> &#8212; Former Attorney-General Tan Sri Tommy Thomas and the Bar Council\u00a0 declined to cooperate with the investigation on the former\u2019s memoirs, &#8220;My Story: Justice in The Wilderness&#8221;, a recently declassified report revealed.<\/p>\n\n\n\n<p>The report by a special task force (STF) investigating 19 allegations made in the memoirs disclosed that Thomas in a letter dated last Jan 5 to the STF chairman stated categorically that he would neither cooperate nor participate in the proceedings of the STF.&nbsp;<\/p>\n\n\n\n<p>STF said Thomas had&nbsp;also questioned the establishment and legitimacy of the STF.<\/p>\n\n\n\n<p><em>\u201cHis letter was premised on his own assumption that the STF was formed to investigate the exercise of his discretion as Public Prosecutor under Article 145(3) of the Federal Constitution to initiate, conduct or discontinue proceedings of criminal nature,\u201d<\/em> the task force said in the report.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/10\/Screenshot-2022-10-22-at-5.03.59-PM-1024x651.png\" alt=\"thomas\" class=\"wp-image-15289\" width=\"604\" height=\"384\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/10\/Screenshot-2022-10-22-at-5.03.59-PM-1024x651.png 1024w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/10\/Screenshot-2022-10-22-at-5.03.59-PM-300x191.png 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/10\/Screenshot-2022-10-22-at-5.03.59-PM-768x488.png 768w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/10\/Screenshot-2022-10-22-at-5.03.59-PM-157x100.png 157w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/10\/Screenshot-2022-10-22-at-5.03.59-PM-350x222.png 350w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/10\/Screenshot-2022-10-22-at-5.03.59-PM-800x508.png 800w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/10\/Screenshot-2022-10-22-at-5.03.59-PM.png 1168w\" sizes=\"auto, (max-width: 604px) 100vw, 604px\" \/><\/figure><\/div>\n\n\n<p>The book, published on or about last Jan 30, caused a public uproar resulting in some 244 reports lodged by various individuals and groups against Thomas and the book.<\/p>\n\n\n\n<p>The STF formed as a fact-finding body to undertake an in-depth review and analysis of the entire book&nbsp; held no less than 37 deliberation sessions, among others to examine whether the publication of the book had potentially violated or contravened any laws or regulations applicable to the office of the Attorney-General (AG).<\/p>\n\n\n\n<p>It was also to determine&nbsp;whether the book had disclosed potential abuse of power by the author,&nbsp; breach of professional ethics&nbsp;or conduct by him.<\/p>\n\n\n\n<p>Explaining further, STF said Thomas&#8217;s views were unfounded and he appeared&nbsp;to have misunderstood the role and duty of the STF.<\/p>\n\n\n\n<p><em>\u201cFirstly, under no circumstances, the STF would act as a substitute for a proper criminal investigation by the police or Malaysian Anti-Corruption Commission. The investigative power is and always will be vested in the enforcement agencies under the relevant laws. The enforcement agencies may of course refer to our report as a basis to initiate a specific direction in their investigation but that is entirely at their discretion.&#8221;<\/em><\/p>\n\n\n\n<p><em>\u201cSecondly, we are not investigating TSTT (Tan Sri Tommy Thomas).
