{"id":14607,"date":"2022-08-14T16:48:37","date_gmt":"2022-08-14T08:48:37","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=14607"},"modified":"2022-08-14T16:48:38","modified_gmt":"2022-08-14T08:48:38","slug":"federal-court-to-hear-najibs-final-src-appeal-tomorrow","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=14607","title":{"rendered":"Federal Court to hear Najib\u2019s final SRC appeal tomorrow"},"content":{"rendered":"\n<p><strong>PUTRAJAYA, Aug 14<\/strong> &#8212; Tomorrow, the Federal Court is scheduled to hear former prime minister Datuk Seri Najib Razak\u2019s appeal against his conviction and sentence for misappropriation of RM42 million of SRC International Sdn Bhd funds.<\/p>\n\n\n\n<p>It is Najib\u2019s final appeal after a three-man bench of the Court of Appeal on Dec 8&nbsp;last year&nbsp;upheld the Pekan MP\u2019s conviction and sentence of 12-year jail and&nbsp;RM210 million fine imposed on him by then High Court Judge Datuk Mohd Nazlan Mohd Ghazali on July 28, 2020.<\/p>\n\n\n\n<p>It is&nbsp;understood that the Federal Court will first hear Najib\u2019s application to adduce new evidence in&nbsp;the SRC case in his bid to ultimately seek a retrial.<\/p>\n\n\n\n<p>If Najib fails in this\u00a0application, the Federal Court is expected to proceed with the hearing of Najib\u2019s appeal against his conviction and sentence.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/05\/Screen-Shot-2022-05-10-at-19.12.20.png\" alt=\"federal court\" class=\"wp-image-13906\" width=\"513\" height=\"277\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/05\/Screen-Shot-2022-05-10-at-19.12.20.png 595w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/05\/Screen-Shot-2022-05-10-at-19.12.20-300x162.png 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/05\/Screen-Shot-2022-05-10-at-19.12.20-185x100.png 185w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/05\/Screen-Shot-2022-05-10-at-19.12.20-350x189.png 350w\" sizes=\"auto, (max-width: 513px) 100vw, 513px\" \/><\/figure><\/div>\n\n\n<p>The court has fixed Aug 15 to 19 and 23 to 26 to hear the appeal.<\/p>\n\n\n\n<p>The 69-year-old politician changed his legal team just 21 days prior to the appeal, by appointing prominent criminal lawyer Hisyam Teh Poh Teik as his lead counsel and&nbsp;law firm Zaid Ibrahim Suflan TH Liew &amp; Partners\u2019 (ZIST) partners Liew Teck Huat and Rueben Mathiavaranam as&nbsp;his new solicitors for the appeal.<\/p>\n\n\n\n<p>Messrs Shafee &amp; Co, led by Tan Sri Muhammad Shafee Abdullah, had represented Najib in the SRC case from the day&nbsp;he was charged. However, on July 26, Najib discharged with immediate effect the firm and lawyers from representing him in his final appeal.<\/p>\n\n\n\n<p>On July 26, Najib\u2019s new lawyers requested the Federal Court to postpone&nbsp;the appeal hearing as a \u201cwholly new team has taken over\u201d the SRC case.<\/p>\n\n\n\n<p>However, on July 28, the Federal Court in a letter rejected&nbsp;the postponement bid and directed that the appeal hearing start on Aug 15 as scheduled.<\/p>\n\n\n\n<p>Najib has submitted 94 grounds in his petition of appeal on why he should be freed of the charges. Among the grounds mentioned in the petition is that both (Court of Appeal and High Court) erred in fact and\/or law by failing to properly evaluate evidence and failing to recognise the differences between proven and unproven facts, and between inferences that might permissibly be drawn and mere conjecture based on suggestion, unsubstantiated allegations, conjecture, suspicion and hearsay.<\/p>\n\n\n\n<p>Najib was charged on July 4, 2018, an unprecedented case in the nation\u2019s judicial history.<\/p>\n\n\n\n<p>On July 28, 2020, Judge Mohd Nazlan, who is now a Court of Appeal judge, sentenced Najib to 10 years&#8217; jail on each of the three counts of criminal breach of trust (CBT) and each of the three counts of money laundering, and 12 years&#8217; jail and a RM210 million fine, in default five years&#8217; jail, in the case of abuse of position.<\/p>\n\n\n\n<p>However, Najib would have to serve only 12 years in jail as the judge ordered all the jail sentences to run concurrently.<\/p>\n\n\n\n<p>Najib is currently out on bail of RM2 million in two sureties pending appeal.<\/p>\n\n\n\n<p>Ad hoc prosecutor&nbsp;Datuk V.
