{"id":14448,"date":"2022-07-27T15:15:17","date_gmt":"2022-07-27T07:15:17","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=14448"},"modified":"2022-07-27T15:15:17","modified_gmt":"2022-07-27T07:15:17","slug":"constitutional-amendment-mps-who-jump-ship-will-lose-seat-ismail-sabri","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=14448","title":{"rendered":"Constitutional amendment : MPs who jump ship will lose seat &#8211; Ismail Sabri"},"content":{"rendered":"\n<p><strong>KUALA LUMPUR, July 27<\/strong> &#8212;\u00a0A Member of Parliament elected by the people through a general election\u00a0will lose the seat that was won, if he or she switches party or commonly known as party hopping.<\/p>\n\n\n\n<p>The matter is contained in the Constitution (Amendment) Bill (No. 3) on the provision of the Prohibition of Members of Parliament from Party Hopping&nbsp;which was tabled&nbsp;for a second reading by Prime Minister Datuk Seri Ismail Sabri Yaakob in the Dewan Rakyat today.<\/p>\n\n\n\n<p>The enacted Constitutional Amendment contains four paragraphs and six clauses, with four of them being new clauses.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/07\/Screenshot-2022-07-27-at-3.12.36-PM-1024x555.png\" alt=\"lose\" class=\"wp-image-14449\" width=\"576\" height=\"312\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/07\/Screenshot-2022-07-27-at-3.12.36-PM-1024x555.png 1024w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/07\/Screenshot-2022-07-27-at-3.12.36-PM-300x163.png 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/07\/Screenshot-2022-07-27-at-3.12.36-PM-768x416.png 768w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/07\/Screenshot-2022-07-27-at-3.12.36-PM-185x100.png 185w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/07\/Screenshot-2022-07-27-at-3.12.36-PM-350x190.png 350w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/07\/Screenshot-2022-07-27-at-3.12.36-PM-800x434.png 800w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/07\/Screenshot-2022-07-27-at-3.12.36-PM.png 1170w\" sizes=\"auto, (max-width: 576px) 100vw, 576px\" \/><\/figure><\/div>\n\n\n<p><em>&#8220;The New Clause 4 aims to insert a new Article 49A into the Federal Constitution to provide that a Member of the House of Representatives shall cease to be a member of the House and his\/her seat shall become vacant as soon as a contingency vacancy date is determined by the Speaker of the House,&#8221;<\/em> said Ismail Sabri.<\/p>\n\n\n\n<p>He said the same applies to Independent MPs who&nbsp;after being elected to the House of Representatives, joins a political party.<\/p>\n\n\n\n<p><em>&#8220;Any Member of Parliament who switches to another political party or\u00a0who leaves the political party of which he was a candidate during the election\u00a0to become an Independent MP, will cease to be a Member of the Dewan Rakyat and will have to vacate his\/her seat,&#8221;<\/em> he said.<\/p>\n\n\n\n<p>Ismail Sabri however said,&nbsp;a Member of Parliament will not lose his seat if he\/she was dismissed by his\/her party or if his \/her political party is dissolved or deregistered.<\/p>\n\n\n\n<p>The bill also repeals the five-year ban on those who resign as members of parliament.<\/p>\n\n\n\n<p><em>&#8220;The new Clause 3 aims to delete Clause (6) of Article 48.
