{"id":13559,"date":"2022-03-23T23:42:05","date_gmt":"2022-03-23T15:42:05","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=13559"},"modified":"2022-03-23T23:42:06","modified_gmt":"2022-03-23T15:42:06","slug":"motion-to-extend-subsection-45-of-sosma-not-approved-by-dewan-rakyat","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=13559","title":{"rendered":"Motion to extend subsection 4(5) of SOSMA not approved by Dewan Rakyat"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>KUALA LUMPUR, March 23<\/strong> &#8212; The motion to extend the enforcement of subsection\u00a04(5) of the\u00a0Security Offences (Special Measures) Act 2012 (SOSMA) for another five years was not approved by the Dewan Rakyat today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The motion, tabled by Home Minister&nbsp;Datuk Seri Hamzah Zainudin, was not passed in a bloc vote which saw&nbsp;84 Members of Parliament (MPs) agreeing and 86 disagreeing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When announcing the vote outcome, Dewan Rakyat Speaker Tan Sri Azhar Azizan Harun said 50 MPs were absent\u00a0during the voting.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/03\/Screen-Shot-2022-03-23-at-23.40.40.png\" alt=\"sosma\" class=\"wp-image-13560\" width=\"517\" height=\"280\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/03\/Screen-Shot-2022-03-23-at-23.40.40.png 587w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/03\/Screen-Shot-2022-03-23-at-23.40.40-300x163.png 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/03\/Screen-Shot-2022-03-23-at-23.40.40-185x100.png 185w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2022\/03\/Screen-Shot-2022-03-23-at-23.40.40-350x190.png 350w\" sizes=\"auto, (max-width: 517px) 100vw, 517px\" \/><\/figure><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier, when winding up the debate on the motion, Hamzah said enforcement of subsection\u00a04(5) of the Act needed to be extended and the 28-day detention period was maintained to give police sufficient time to complete their investigations into difficult and complex cases of\u00a0security offenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cWithout\u00a0this subsection being extended, it is feared that the quality of police investigation\u00a0would be affected it has to be\u00a0done hastily, that is only\u00a024 hours to conduct an investigation, prepare and complete investigation papers, and submit them to the deputy public prosecutor for further instruction,\u201d<\/em> he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The last time a five-year extension for the subsection was considered and approved by Parliament was on April 4,&nbsp;2017, which means it will end on July 31 this year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier,&nbsp;16 MPs took part in the debate, with the opposition bloc generally not agreeing to the motion on the ground that they feared an extension of the&nbsp;subsection could be abused for political purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his reply, Hamzah said the claim was an incorrect negative perception, as subsection 4(3) of the Act clearly states that no one can be arrested and detained under that&nbsp;subsection merely because of his political belief or activities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cTherefore, the question of\u00a0police abusing political issues does not arise.
