{"id":12612,"date":"2021-12-08T16:45:14","date_gmt":"2021-12-08T08:45:14","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=12612"},"modified":"2021-12-08T16:45:14","modified_gmt":"2021-12-08T08:45:14","slug":"najibs-conduct-not-in-national-interest-but-a-national-embarrassment-judge","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=12612","title":{"rendered":"Najib&#8217;s conduct not in national interest but a national embarrassment &#8211; Judge"},"content":{"rendered":"\n<p>PUTRAJAYA, Dec 8\u00a0&#8212; The Court of Appeal today ruled that Najib Razak\u2019s conduct in relation to the SRC International Sdn Bhd case cannot be said to have served the national interest as it had turned out to be a\u00a0national embarrassment.<\/p>\n\n\n\n<p>Justice Datuk Abdul Karim Abdul Jalil said Najib&nbsp;was actively involved in ensuring that the RM4 billion of Retirement Fund Inc (KWAP) loans were disbursed to the company&nbsp;but, after the funds had been disbursed, the appellant (Najib) came indifferent to the whereabouts of the funds.<\/p>\n\n\n\n<p>In a 54-page of summary\u00a0judgment,\u00a0Justice Abdul Karim said\u00a0the former prime minister did not even ask\u00a0SRC International as to what had happened to the funds, nor how it was utilized and for what purpose.<\/p>\n\n\n\n<p><em>\u201cHe even instructed the second Finance Minister then (Datuk Seri Ahmad Husni Hanadzlah) to keep off SRC.&#8221;<\/em><\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/12\/Screen-Shot-2021-12-08-at-16.41.26.png\" alt=\"national interest\" class=\"wp-image-12613\" width=\"489\" height=\"267\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/12\/Screen-Shot-2021-12-08-at-16.41.26.png 583w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/12\/Screen-Shot-2021-12-08-at-16.41.26-300x164.png 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/12\/Screen-Shot-2021-12-08-at-16.41.26-183x100.png 183w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/12\/Screen-Shot-2021-12-08-at-16.41.26-350x192.png 350w\" sizes=\"auto, (max-width: 489px) 100vw, 489px\" \/><\/figure><\/div>\n\n\n\n<p><em>\u201cThis conduct of the appellant can be indicative of only one thing, and that is, once the funds had been secured by SRC International, over which the appellant had overarching control, he was free to utilize them for his personal benefit.&#8221;<\/em><\/p>\n\n\n\n<p>\u201c<em>This is manifested by the flow of the RM42 million from SRC International into his personal accounts. This is not something that can be said to have been done in the national interest. There is no national interest here, just a national embarrassment<\/em>,\u201d said Justice Abdul Karim who delivered the verdict with Justices Datuk Has Zanah Mehat and Datuk Vazeer Alam Mydin Meera.<\/p>\n\n\n\n<p>Justice Abdul Karim said the fact that Najib took part in the two Cabinet decisions to issue the two government guarantees to KWAP for the loans granted by KWAP to SRC was beyond question.\u00a0<\/p>\n\n\n\n<p><em>\u201cThe evidence shows that the appellant was not only present but chaired the two Cabinet meetings held on Aug 17, 2011, and Feb 8, 2012, and was thus involved in the decisions of the Cabinet to approve the said government guarantees in favor of KWAP,\u201d<\/em> he said.<\/p>\n\n\n\n<p>The judge said&nbsp;the matter was confirmed by Tan Sri Mazidah Abdul Majid (the 40th prosecution witness)&nbsp;&nbsp;who was the then Deputy Head Secretary (Cabinet) in the Prime Minister&#8217;s Department.<\/p>\n\n\n\n<p><em>\u201cMazidah confirmed that the appellant did not declare his interest in both Cabinet decisions, nor did he withdraw from the discussion in respect of these two items on the agenda, nor did he leave the meetings.&#8221;<\/em><\/p>\n\n\n\n<p><em>\u201cSuch conduct would militate against the appellant and would go towards establishing the charge under Section 23 (1) of the Malaysian Anti-Corruption Commission\u00a0 (MACC) Act 2009,\u201d<\/em> he said.<\/p>\n\n\n\n<p><a href=\"https:\/\/newmalaysiatimes.com\/\">NMT<\/a> as reported by <a href=\"https:\/\/www.bernama.com\/en\/news.php?id=2031457\">Bernama<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>PUTRAJAYA, Dec 8\u00a0&#8212;
