{"id":11616,"date":"2021-09-20T19:38:45","date_gmt":"2021-09-20T11:38:45","guid":{"rendered":"https:\/\/newmalaysiatimes.com\/?p=11616"},"modified":"2021-09-20T19:38:46","modified_gmt":"2021-09-20T11:38:46","slug":"rm6-million-to-yayasan-akalbudi-a-donation-not-a-bribe-lawyer","status":"publish","type":"post","link":"https:\/\/newmalaysiatimes.com\/?p=11616","title":{"rendered":"RM6 million to Yayasan Akalbudi a donation, not a bribe &#8211; Lawyer"},"content":{"rendered":"\n<p>KUALA LUMPUR, Sept 20 &#8212; The High Court was told today that the RM6 million channeled to charitable foundation Yayasan Akalbudi (YAB), owned by Datuk Seri Dr. Ahmad Zahid Hamidi, was a political and charitable donation, and not a bribe to secure a project.<\/p>\n\n\n\n<p>Ahmad Zahid\u2019s counsel, Hamidi Mohd Noh, said this in response to a question by High Court judge, Datuk Collin Lawrence Sequerah, on why the RM6 million was channeled to YAB if the money was meant as a political donation.<\/p>\n\n\n\n<p>The question was posed to Hamidi when he was submitting about two cheques, totaling RM6 million, which were sent to YAB as stated in the 14th and 15th corruption charges.<\/p>\n\n\n\n<p>Hamidi replied that the 32nd prosecution witness and former Datasonic Group Bhd chief executive officer, Datuk Abu Hanifah Noordin, who donated the RM6 million, was of the view that \u2018political donation\u2019 and \u2018charitable donation\u2019 are the same thing.<\/p>\n\n\n\n<p>Justice Sequerah: If it is meant as a political donation, why would the money be channeled to YAB? What do you mean by \u201cpolitical also charity\u201d?<\/p>\n\n\n\n<p>Hamidi: I quote Abu Hanifah\u2019s testimony in court &#8211; \u2018It is a political donation, I would also say it is a charitable donation. To him (Abu Hanifah) it (the term) is interchangeable.<\/p>\n\n\n\n<p>Previously, the 34th prosecution witness, former Datasonic Group Berhad\u2019s deputy managing director, Chew Ben Ben, had testified that in April 2017, he handed over the two cheques totaling RM6 million to Ahmad Zahid at his official residence (as the deputy prime minister at the time), and had also told the court that the money was meant as \u201cpolitical donations to Barisan Nasional\u201d through Ahmad Zahid.<\/p>\n\n\n\n<p>Today, Hamidi said that the two cheques, that were both made payable to law firm Lewis &amp; Co\u2019s client account, were held in trust for YAB.<\/p>\n\n\n\n<p>The lawyer also submitted to the court that Chew, whom he described as the single most important witness for charges 14 and 15, told the court that the two charges against Ahmad Zahid were \u2018fitnah\u2019 (slander).<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/09\/Screen-Shot-2021-09-01-at-17.58.52.png\" alt=\"donation\" class=\"wp-image-11240\" width=\"501\" height=\"272\" srcset=\"https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/09\/Screen-Shot-2021-09-01-at-17.58.52.png 589w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/09\/Screen-Shot-2021-09-01-at-17.58.52-300x163.png 300w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/09\/Screen-Shot-2021-09-01-at-17.58.52-184x100.png 184w, https:\/\/newmalaysiatimes.com\/wp-content\/uploads\/2021\/09\/Screen-Shot-2021-09-01-at-17.58.52-350x190.png 350w\" sizes=\"auto, (max-width: 501px) 100vw, 501px\" \/><\/figure><\/div>\n\n\n\n<p>Hamidi was referring to Chew\u2019s testimony, where he denied giving a bribe or reward to Ahmad Zahid for Datasonic Technologies Sdn Bhd to get a contract from the Home Affairs Ministry.<\/p>\n\n\n\n<p>\u201cChew\u2019s testimony had single-handedly buried the prosecution\u2019s case for these two charges. It was ridiculous for the Malaysian Anti-Corruption Commission to file the charges, and for a witness to then come to court and say that such charges are \u201cfitnah\u201d.<\/p>\n\n\n\n<p>\u201cBased on Abu Hanifah\u2019s witness statement, it is not unusual for Datasonic Group and Datasonic Technologies to be awarded government contracts, as it has been establishing its own reputation and standing in executing government contracts over the years,\u201d he said.<\/p>\n\n\n\n<p>At this juncture, Justice Sequerah then asked: Wouldn\u2019t he (the witness) be inclined to distance himself from corrupt practices (in obtaining the contract)?<\/p>\n\n\n\n<p>Hamidi responded that it was the defense argument that there was no element of corruption.\u00a0<\/p>\n\n\n\n<p>\u201cThe witness (Chew) came to court and said it as it is. It is a \u201cfitnah\u201d.
